The High Court on Tuesday (January 27) declared the nomination of BNP candidate Sarwar Alamgir for the Chattogram-2 constituency valid ordering the restoration of his candidacy.
A High Court bench comprising Justice Fahmida Kader and Justice Md Asif Hasan passed the order.
Senior Advocate Ahsanul Karim and Barrister Ruhul Quddus Kajol appeared in the bench on behalf of the writ petitioner, while Barrister SM Shahriar Kabir stood for the Jamaat-e-Islami candidate.
Earlier, BNP-nominated candidate for Chattogram-2 (Fatikchhari) Sarwar Alamgir filed the writ petition with the High Court seeking restoration of his candidature after it was cancelled by the Election Commission.
On January 22, the Chamber Court upheld a High Court order removing Sarwar Alamgir's name from the list of loan defaulters, following the rescheduling of his loan.
However, on January 18, the Chamber Judge Court had stayed the same High Court order, acting on an application filed by Premier Leasing and Finance.
The stay order was issued by the court of Chamber Justice Md Rezaul Huque last Sunday after hearing the petition filed by Premier Leasing.
Prior to these developments, the High Court had ordered that Sarwar Alamgir's name be removed from the list of loan defaulters. On the same day, the Election Commission cancelled his nomination as a BNP candidate for the Chattogram-2 (Fatikchhari) constituency.
With Tuesday's verdict, the High Court has directed that Sarwar Alamgir's candidacy be reinstated, clearing the way for him to contest the election.
