Court orders ex-CJ Khairul Huq to be shown arrested in new case

The Dhaka Metropolitan Magistrate Court has ordered former Chief Justice ABM Khairul Huq to be shown arrested in a case involving attempted murder and explosives. 

Dhaka Metropolitan Magistrate Arifur Rahman's court passed the order on Wednesday (July 8) morning after a virtual hearing.

Prosecution Department's sub-inspector Moktar Hossain confirmed it.

During the July Mass Uprising on August 4, 2024, there was an attack in front of the Setu Bhaban at Mohakhali in Dhaka. Attacks, gunfire, and cocktail-bomb explosions directed at protesters marching toward Shahbagh.

The case was filed at Banani Police Station by Uzzal Mia, who was among 25–30 people injured in the attack. He was shown arrested by police from his Dhanmondi residence on July 24, 2025. 

With Wednesday's new court order, the former chief justice has now been shown arrested in a total of 9 cases. He had secured bail from the High Court and Appellate Division in the previous 8 cases. This new arrest order halts his release from prison.

He has been in continuous detention since his arrest by the Detective Branch (DB) of police from his Dhanmondi residence on July 24, 2025. His defense lawyer, Monayem Nabi Shaheen, expressed frustration, stating that as soon as his client secures bail in existing cases, he is continuously shown arrested in new ones.

Justice ABM. Khairul Huq served as the 19th Chief Justice of Bangladesh from September 30, 2010, to May 17, 2011. Notably, his Appellate Division bench abolished the caretaker government system by declaring the 13th Amendment of the Constitution void in 2011.

Meanwhile, the High Court has directed not to arrest or harass the former chief justice without a specific case naming him as an accused. On May 17, a High Court bench comprising Justice Debashish Roy Chowdhury and Justice Razik-Al-Jalil passed this order along with a rule.

After being granted bail in seven separate cases on May 23 last, former chief justice ABM Khairul Haque was newly shown arrested in Khowaib murder case at Jatrabari Police Station. 

Later on June 30, the High Court granted bail to Khairul Haque in this case. The High Court bench of Justice KM Zahid Sarwar and Justice Sheikh Abu Taher passed the order. 

Later, the state filed an application with the Appellate Division seeking a stay on that order. 

On July 2, the Appellate Division Chamber Judge Justice Md Rezaul Haque ordered to uphold his bail.
